Having spent years consulting on AI implementation across financial services, there’s a shift that can no longer be ignored. Artificial intelligence has moved from research labs into boardrooms and client meetings. Voice‑to‑text transcription, generative summaries and natural‑language assistants are now commonly used to speed up compliance checks and client onboarding. Nowhere is this shift more visible than in Know Your Customer (KYC) procedures, where firms must collect and verify sensitive information about individuals and organisations. The efficiency gains are clear; the trust implications are less so. As AI systems process more personal data, two concepts, Empathetic AI and AI Consent, become essential. They are not industry‑specific buzzwords; they are foundational principles that cut across finance, legal services, counselling and any field that deals with sensitive client data.

Unlike basic chatbots that simply complete tasks, empathetic systems are trained to tailor their responses to the user’s emotional state: offering reassurance to a frustrated client or enthusiasm to celebrate a success. They do not feel emotions, but they aim to make interactions more human‑centred. When implemented responsibly, empathetic systems can de‑escalate frustration and make users feel heard.

Understanding AI Consent

AI Consent goes beyond ticking a box. It means informing individuals about how their data will be used by artificial intelligence, ensuring they understand and agree. In regulated industries, consent builds trust between the public and AI developers and ensures that data processing complies with legal standards. Using personal data without clear consent can have serious consequences: legal repercussions, reputational damage and heightened security risks. Recent legislative efforts, including the AI CONSENT Act in the United States and provisions in the EU AI Act, underscore the global push to make informed consent a legal requirement.

Empathetic AI Meets KYC: More Than a Banking Issue

KYC procedures are vital for combating fraud, identity theft and money laundering. As digital platforms rise, KYC has expanded beyond banking to sectors such as legal services, education and healthcare. Law firms verify client identities and prevent conflicts of interest; universities check the backgrounds of students and staff; healthcare providers confirm patient identities to comply with privacy rules. Across these sectors, AI‑driven tools now scan passports, compare facial images, analyse voice prints and mine historical data for adverse media.

These applications are powerful, but they also raise privacy questions. Digital KYC relies on biometrics and AI‑driven analytics, so it must align with data‑protection frameworks such as GDPR, CCPA and other regional laws. Clients increasingly demand transparency about what happens to their data and expect firms to practise data minimisation. When AI systems are layered on top of KYC processes – transcribing calls, summarising meetings or generating reports – the data moves through multiple vendors, cloud services and AI subsystems. Without proper oversight, de‑identified recordings or documents could be used to refine commercial models without the client’s knowledge, creating an AI Consent gap.

Beyond Finance: Sensitive Use‑Cases Require Empathy and Consent

Consider a solicitor’s consultation, a counselling session or a medical appointment. Recording these interactions for accuracy or regulatory reasons is becoming common practice. The same AI tools that summarise financial meetings can also generate case notes, client letters and treatment plans. However, the stakes are even higher when dealing with trauma, criminal matters or medical histories. If these recordings are processed by third‑party AI services without explicit AI Consent, trust can be destroyed. Professionals who cannot explain how data is used cannot obtain meaningful consent, leaving clients to choose between efficiency and privacy.

How to Close the AI Consent Gap

  1. Be Transparent – Saying “this meeting is being recorded” is not enough. Explain what systems are involved, where data will be processed, whether human reviewers or model training will occur and how long information will be stored. Clear, accessible language helps clients understand. Under GDPR and other frameworks, firms must ensure that data collection is fair, lawful and transparent.
  2. Map the Data Journey – Identify all vendors and APIs that touch client data. Ask them where data is processed, whether it will be used to improve AI models and whether clients can opt out. Document these flows so you can respond to data‑access requests.
  3. Practise Data Minimisation – Collect and retain only the information necessary to verify identity or deliver the service. Delete or anonymise data as soon as the legal retention period expires. Less data means fewer risks.
  4. Adopt AI‑Aware Governance – Train staff to understand how Empathetic AI works so they can explain it to clients. Regulators are developing rules across jurisdictions, so staying ahead of compliance is crucial. Consider appointing a chief AI officer or engaging external specialists who understand technical, ethical and legal dimensions.
  5. Maintain the Human TouchEmpathetic AI should augment, not replace, professionals. Automation can help with tasks such as media checks and organising information, but human expertise is still needed to interpret nuanced legal issues, counsel clients or make investment decisions. Maintaining empathy ensures that clients feel valued even when technology does much of the heavy lifting.

I believe that artificial intelligence will continue to transform regulated and sensitive sectors. Voice notes, biometric scans and generative reports will become mainstream across industries.
